Who owns the rushes and the source files?
The finished deliverable is always yours. Unedited rushes stay with the studio; the source code of a delivered website, on the other hand, is yours in full unless the quote says otherwise.
The answer is not the same for a video and for a website, and it deserves to be asked before a quote is signed rather than after. In short: on a video production you own the finished film, not the raw unedited footage; on a website you own all of the delivered code, bar any exception spelled out explicitly.
Who owns the footage that was shot but never edited (the rushes)?
On a video quote, what you pay for is the finished piece: the film edited, graded and delivered in the agreed formats. The rushes, meaning every frame that was filmed, including everything left out of the edit, remain the property of the production company. On a shoot of several hours, only a few minutes usually survive into the final cut; the whole belongs to the studio.
Can the studio reuse that footage?
Yes. The production company may use the rushes and the delivered exports to show its own work: showreel, portfolio, social. The exception is a confidentiality clause agreed beforehand, which does happen, for instance on a sensitive project or a launch that has not been announced.
Who owns the source code of a delivered website?
You do. As soon as the site is delivered and paid for, all of the code is yours, line by line. The only exception covers technical elements identified precisely as excluded in the quote, for reasons of security, third-party tool ownership or licensing, and in that case the clause has to be written down in black and white, not implied.
What to check before signing
Two points to have put in writing before any shoot or build: what the studio may do with the footage for its own communication, and, on the web side, the exact list of anything excluded from the transfer of the code, if there is any. Absent a clause to the contrary, the default stays simple: the finished video and the website source code are yours, the video rushes stay with the studio.
